He said he couldn't fairly defend the motion while also answering the court's March 23 order demanding clarification on who actually authored his filings, and plans to refile after his direct appeal and reassignment requests are ruled on. The conviction appeal remains pending at the Second Circuit while he serves time at FCI Lompoc.
